  3. Relevant States and Territories: New South Wales (NSW), Queensland (QLD), Victoria (VIC), Tasmania (TAS), South Australia (SA), Western Australia (WA), Northern Territory (NT), Australian Capital Territory (ACT).

    Entry Restrictions:
    1. An individual must reside at a registered address in VIC, NSW, QLD, WA, SA, TAS, ACT and NT at the time of entry to be eligible for the Weekly Prize/s (Entrants).
    2. If under 18 years of age at the time of entry, Entrants must have the express permission of a parent or guardian to enter. If the Entrant is under 18 years of age at the time of entry and cannot provide express permission of a parent or guardian in writing at the request of the Promoter, the Entrant will be deemed invalid and forfeit any prize/s or entitlements associated with the Competition. If an Entrant is under 18 years of age at the time of claiming the prize, they will be required to take the prize accompanied by a parent, legal guardian or otherwise responsible adult.
    3. Employees, directors, and/or officers (including immediate family members or members of the household) of the Promoter, its subsidiaries, affiliated companies, distributors, advertising, fulfilment and promotion agencies and all other companies or entities associated with the Competition are not eligible to participate. For the avoidance of doubt, competing teams in the Virgin Australian Supercars Championship (VASC) are excluded from participating in the Competition.

  6. Participation constitutes Entrant’s full and unconditional agreement and acceptance of these Terms and Conditions which shall be final in all respects.
  7. How to Enter & Win During the Competition period:
    1. Entrants will be invited to visit the Website and complete the online registration form by providing their contact details (name, email phone number, post code) and must agree to these Terms and Conditions.
    2. Entrants must then complete the Pit Stop Game to record their fastest time.
    3. Entrants may complete the Pit Stop Game at any time during the Competition Period and may complete the games as many times as they wish.
    4. Entrant’s fastest times are automatically reset at 11.59pm AEST / AEDT on the Sunday of each week during the Competition Period.
    5. Each week during the Competition Period, the Entrant with the overall fastest time for completion out of all Eligible Entries is the Weekly Winner.
    6. This is a game of skill and luck plays no chance in determining the weekly winner(s).
    7. All entries, once submitted, become the property of the Promoter and shall not be returned. Any incomplete entries will not be eligible. The Promoter reserves the right to verify the validity of each entry and disqualify any person for tampering with the entry process or who does not comply with the terms set forth for the Competition as determined at the Promoter’s sole and absolute discretion.
  8. Limitation on Entries: There is a limit of one (1) entry per Entrant throughout the Competition Period. Any attempt by any Entrant to obtain more than one (1) entry through multiple/different email addresses, name, phone number or address, where relevant to the type of entry method, will void that Entrant’s entry and they will be ineligible to win the prize/s as determined by the Promoter at its sole and absolute discretion.
    Prize Details:
    1. There are thirty (30) Weekly Prizes in total, with one (1) to be won each week by the Entrant who has the fastest time for completion of the Pit Stop game.
    2. Each Weekly Prize consists of one (1) x AUD$50 Coles Express EFTPOS Gift Card valued at up to AUD$50.00 (incl. GST).
    3. In the event more than one Entrant records the fastest time in any given week, the tied Entrants will be separated by the which of the Entrants recorded their time first, with the Entrant who recorded the fastest time first adjudicated to be the Weekly Winner.
    4. The prize/s are non-transferable and must be redeemed by the registered Entrant. If the prize winner is unable to take any element of the prize/s for any reason, that prize element will be forfeited, and no compensation will be provided as determined by the Promoter at its sole and absolute discretion.
  9. Total Prize Value: Up to AUD$1,500 (incl. GST)
  10. Prize Notification: Winners will be notified by a representative of the Promoter via phone or email where relevant to the Competition no later than 5 business days after their relevant weekly prize win.
  11. Prize Claim & Delivery: Once notified, Weekly Prize Winners will have 5 business days to claim their prize via return correspondence to the Promoter.
  12. Special Conditions:
    1. If these rules differ from any promotional or other materials published in connection with the Competition, these rules shall take precedent over any other material published in relation to the Competition.
    2. By entering this Competition, Entrants grant to the Promoter, and any third party associated with the Competition, including without limitation prize suppliers, a perpetual, non-exclusive, royalty free licence to use the materials for the purposes of conducting the Competition including online and/or on air and for marketing and promotional purposes without additional compensation.
    3. By entering this Competition, where allowable by law, the Entrant grants to the Promoter, and any third party associated with the Competition, the worldwide right to publish, broadcast and use in any media, including the World Wide Web, participant’s entry, name, picture, and likeness, without limitation, for promotional and advertising purposes without additional compensation.
    4. By entering this Competition, Entrants agree to be contacted by the Promoter, Viva Energy Australia Pty Ltd and any third party associated with the Competition for marketing and promotional purposes. If an Entrant does not wish to be contacted for marketing or promotional purposes, an Entrant will be able to unsubscribe from being contacted by the Promoter, Viva Energy Australia Pty Ltd and any third party associated with the Competition by clicking ‘unsubscribe’ in any marketing or promotional email received by the Entrant in relation to the Competition.
    5. The Promoter accepts no responsibility for an Entrant’s late, lost, incomplete, misdirected, incorrectly submitted, or delayed entry whether (or not) due to, but not limited to, error, hackers, failure of any electronic equipment, computer transmission and/or network connections.
    6. The Promoter reserves the right to cancel or modify the Competition or these Terms and Conditions if fraud, technical failures or any other factor beyond the Promoter’s reasonable control impairs the integrity of the Competition, as determined by the Promoter at its sole discretion.
  13. Liability:
    1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth), or similar state-based consumer protection laws (Non-Excludable Guarantees).
    2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Entrants (and if you are a minor, your parents or legal guardians) accept all risk and consequences of entry and participation in this Competition, and agree to release and hold the Promoter, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Competition, including but not limited to, your entry and participation in this Competition, the acceptance and/or use (or misuse) of any Round Prize(s) and/or Major Prizes(s), printing errors, any claims based upon rights of publicity and invasion of privacy.
    3. Entrant’s shall indemnify the Promoter, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to Entrant’s violation or inaccuracy of any warrantees or representations made relating to this Competition. The Promoter assumes no responsibility for errors which may occur in the transmission of the Entrant’s entry.
    4. The Promoter is not responsible for any fraud or misconduct on the part of the Entrant(s). Should an Entrant engage in fraud or misconduct of any nature, including, but not limited to, a violation of these Terms and Conditions, such Entrant shall be subject to immediate disqualification.
    5. The Promoter reserves the right to terminate, modify or amend the Competition at any time if the fairness, integrity, and or proper administration of the Competition is jeopardised.
    6. In no event shall the Promoter be liable to an Entrant for any lost profits, or for any special, incidental, consequential or other indirect damages arising out of or in connection with this contest. Entrant’s sole damages shall be limited to Entrant’s actual out of pocket expenses, excluding attorneys’ fees.
    7. Without limiting the generality of the foregoing, such prizes are provided "as is" without warranty of any kind, either express or implied, and contest entities hereby disclaim all such warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purposes and/or non-infringement.
  14. Laws: These terms and conditions shall be governed by, construed, and enforced in accordance with the laws of the state of Victoria, Australia without regard to any choice of law principles. The Entrant hereby agrees and irrevocably consents to submit to the exclusive jurisdiction and venue of the courts of the State of Victoria and of Australia for any and all claims arising from or related to this Competition. Entrant agrees that all claims relating to this Competition shall be resolved individually, without resort to any form of class action.
  15. Entire Agreement: These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written.
